Judge Denies Defense Request for a Hearing on Clancy Holdout Juror

The juror at the center of the Lindsay Clancy mistrial will not be called back to court to answer the defense's questions. Plymouth Superior Court Judge William Sullivan on Wednesday denied defense attorney Kevin Reddington's motion for an evidentiary hearing into the holdout, who is called "Juror Doe" in court documents, according to Fox News, and is understood to be Michael Desronvil.

Reddington wanted the juror questioned, his cellphone records examined and his juror questionnaire reviewed, the Daily Wire reported. The judge said no. According to Fox News, Sullivan wrote that the potential grounds for removing the juror came to light only after the mistrial was declared, which Fox says makes them irrelevant under court precedent. We have not reviewed the order, so that account has not been independently confirmed.

What the Defense Wanted, and Why It Lost

The Daily Wire reported that Sullivan also said the court cannot probe a juror's private reasoning during deliberations, and that legal scholars had warned the inquiry would set a dangerous precedent for future jurors.

Desronvil's own lawyer was less diplomatic about the motion, calling it "Looney Tunes," Fox News reported.

A Divided Jury and a Disputed Account

Clancy, a former labor and delivery nurse, admits the killings of her three children, who were between 8 months and 5 years old, and is pursuing an insanity defense, according to the Daily Wire. The outlet reports she faces life in prison and is held at Tewksbury Hospital, a state psychiatric facility.

The mistrial came last month, after days of deliberation, the Daily Wire reported. A Fox photo caption puts the date at Sept. 4, and Fox says Sullivan gave the defense one hour to appeal before declaring it. The Daily Wire, citing other jurors it did not name, reported that 11 of the 12 were ready to find Clancy not guilty by reason of insanity; Fox says those 11 favored a not-criminally-responsible finding because of postpartum psychosis. That figure rests on unnamed jurors and has not been confirmed.

Where the holdout stood is also reported differently. Fox describes him as the lone vote to convict. The Daily Wire says he refused to find her not guilty by reason of insanity and that he said the evidence showed she was not psychotic.

The Juror Speaks for Himself

The allegations against Desronvil come from Reddington and other jurors, and he denies them, according to Fox. The Daily Wire reported that he was doxxed online and then went public, and that in a late-September video he said, "we want to reel everything back and put the focus on the three angels at hand." The Daily Wire also reported that his attorneys said in late September they planned a bar complaint against Reddington; whether one was filed is unclear.

Fox reported that Desronvil told its host Kayleigh McEnany last week that he stands by his decision. He denied lying on the questionnaire, said jurors used phones only during breaks, and denied ignoring reasonable doubt.

What Comes Next

The fight is not over. Fox News reported that Reddington has asked the court to preserve records from all 12 jurors and six alternates, including questionnaires, hallway surveillance video and phone sign-in sheets. Prosecutors have not said whether they will retry Clancy, according to the Daily Wire, and it is not known whether the defense will appeal the ruling. We were also unable to confirm reports that a defense motion to dismiss the murder charges on double-jeopardy grounds is still pending.
